Egg Donor Future Parents

When building your family with donor gametes (egg, sperm, embryo), it is imperative you understand your legal status, rights, and obligations under the law. A contract between donor and recipients provides the prospective parents, and the donor, a level of protection, comfort and security in the family building journey.

Clinic consent forms are not contracts between recipients and donors. They were drafted on behalf of the clinic for the purpose of the clinic’s legal protection in their relationship with their patients. Clinic consent forms are documents of a different nature than a legal agreement between recipients and donors. They are not designed to outline the duties, obligation, and relationship between the donor and recipients.

Donor Agreements

Donor agreements are typically 20-25 pages in length, and include among other things the following:

-Informed Consent

-Relinquishment of rights by donor

-Establishment of recipients as legal parents

-Matters of payment, breach, anonymity, and future contact

-Control and disposition of future embryos
